CustomAddict (operated by We Can Custom LLC) respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), we will respond expeditiously to claims of copyright infringement committed using our website.

1. Our Role as a Service Provider

As a Print-on-Demand (POD) provider, CustomAddict provides a platform for users to upload and print their personal designs/photos onto our throw pillows. We do not proactively screen all content uploaded by users. However, we take copyright infringement very seriously and will remove infringing content once notified.

2. Notice of Copyright Infringement

If you are a copyright owner, or authorized to act on behalf of one, please report alleged copyright infringements taking place on or through the site by completing a Notice of Alleged Infringement and delivering it to our designated agent.

To be effective, the notification must include:

• Identification of the copyrighted work that you claim has been infringed.
• Identification of the material that is claimed to be infringing (including the URL of the product page).
• Your contact information: Address, telephone number, and email address ([email protected]).
• A statement of good faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement of accuracy: A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
• Physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

3. User Responsibility

By using our services and uploading designs for your Throw Pillow, you represent and warrant that:

• You own the copyright or have the necessary licenses and permissions to use the images.
• The content does not infringe upon the intellectual property rights or privacy rights of any third party.
• CustomAddict reserves the right to cancel any order and terminate the account of users who repeatedly infringe upon copyrights.

4. Counter-Notification

If you believe that your material was removed by mistake or misidentification, you may submit a counter-notification to us. This must include your contact info, identification of the material removed, and a statement under penalty of perjury that you have a good faith belief the material was removed in error.
